Terms of Service

These Terms govern your use of the Vibe Fest 2026 companion app (the "App"), operated by Vivabyte LLC, a Wyoming limited liability company ("Vivabyte," "we," or "us"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. What the App Is
The App is an informational companion to the Vibe Fest 2026 event: schedule, lineup, activities, map, and related festival information, plus an optional community board where attendees can coordinate with one another.
Vivabyte LLC builds and operates the App. Vivabyte is not the organizer or promoter of the festival, does not sell tickets, and does not control the event. The Vibe Fest name and related marks belong to the festival organizer and are used with permission. Questions about tickets, entry, refunds, or the event itself should go to the organizer, not to us.
2. Festival Information Is Not Guaranteed
Set times move, artists cancel, and activities change — sometimes with no notice at all. We publish festival information as provided to us and update it when we can, but we do not warrant that anything shown in the App is accurate, complete, or current. Always confirm important details with the organizer or on-site signage.
The App is designed to work offline, which means information may be cached on your device and may be out of date until you reconnect.
3. Age Requirement
You may browse the festival information at any age appropriate for the event itself. The community board is restricted to users aged 18 and over. Before participating you must confirm that you meet this requirement, and you agree that the confirmation you provide is truthful.
4. Accounts
Browsing requires no account. Posting, messaging, reporting, and blocking require you to sign in with Google or with an emailed code. You agree to provide accurate information, to use an account that belongs to you, and not to share access with anyone else. You are responsible for activity that occurs under your account.
You can delete your account at any time from within the App, or by emailing ron@vivabyte.app from the address associated with it. Deleting your account removes your profile and your posts, and anonymizes your direct messages — the other person's side of a conversation is preserved, and you will appear to them as "Deleted account." If your account was banned, we keep a minimal anonymized record to prevent the ban being evaded. See the Privacy Policy for the full detail.
5. Community Board Rules
The board exists so attendees can find rides, share rooms, and form crews. When posting or messaging, you agree not to:
- Harass, threaten, stalk, or abuse anyone
- Post hateful content targeting people based on who they are
- Offer, solicit, or arrange anything illegal, including drugs or weapons
- Post sexual content, or solicit anyone sexually
- Impersonate another person or misrepresent who you are
- Post another person's private information without their consent
- Spam, advertise, scalp tickets, or run any commercial promotion
- Attempt to defraud, scam, or extract payment under false pretenses
- Interfere with the App's operation or attempt to access data that is not yours
You keep ownership of what you post. By posting, you grant Vivabyte a non-exclusive, royalty-free license to display, store, and distribute that content within the App for the purpose of operating it.
6. Moderation
Posts and direct messages are stored on our servers and may be reviewed by festival organizers and moderators for safety purposes, including when content is reported. Messages are not private from moderators and are not end-to-end encrypted.
We may remove content, hide posts, suspend accounts, or ban users at our discretion, with or without notice, particularly where safety is a concern. We are not obligated to monitor content, and the absence of moderation on any given post does not imply approval of it.
7. Meeting People In Person
The community board connects you with strangers. Vivabyte does not verify anyone's identity, run background checks, or vet posts before they appear. Arrangements you make — sharing a car, splitting a room, meeting up — are entirely between you and the other person, at your own risk.
We strongly encourage you to meet first in a public place, tell someone you trust where you are going, verify who you are dealing with independently, and never send money to someone you have not met. Trust your instincts and disengage if something feels wrong.
Vivabyte is not a party to any arrangement made through the App and accepts no responsibility for the conduct of any user, whether online or in person. If someone behaves badly, report them in the App, and contact festival security or law enforcement if you are in danger.
8. Notifications
If you enable festival alerts, we may send notifications about schedule changes and announcements. You can turn these off at any time in your browser or device settings. Notification delivery depends on services operated by your browser vendor and cannot be guaranteed — do not rely on a notification arriving in time for anything important.
9. Availability
We provide the App as a free service and make no promise that it will be available, uninterrupted, or error-free. We may change, suspend, or discontinue any part of it at any time, including after the festival ends.
10. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, Vivabyte LLC and its member, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the App.
To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed one hundred US dollars ($100). This reflects that the App is provided free of charge.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnity
You agree to indemnify and hold harmless Vivabyte LLC from any claim, loss, or expense, including reasonable legal fees, arising from your content, your use of the App, your violation of these Terms, or your interactions with other users.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction. If you are a consumer in a jurisdiction that grants you the right to bring proceedings locally, this does not remove that right.
14. Changes to These Terms
We may update these Terms. When we do, we will change the "Last updated" date above. Continuing to use the App after a change means you accept the revised Terms.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
